Joint Committee report makes case against ACTA: Greens

The Australian Greens have welcomed the Joint Standing Committee on Treaties report into the Anti-Counterfeiting Trade Agreement (ACTA) tabled today.

“The Joint Standing Committee on Treaties has thoroughly examined the text, the arguments and the positions taken by other governments and sees the writing on the wall; there appears a very real possibility that ACTA will not be ratified by sufficient countries in order to come into existence," said the Greens communication spokesperson, Senator for Western Australia Scott Ludlam.

“The Greens would welcome ACTA being ruled out completely because the content of this treaty is fatally flawed and the process that brought it about was shamefully and unnecessarily secretive. While our government did hold consultations they were farcical because those being consulted did not have the secret text and therefore couldn’t provide advice and feedback.

“Australia’s parliamentary committee is not alone in its detailed criticism of this Agreement. No less than five European Parliament Committees have recommended it be rejected. Several EU countries have suspended consideration until further notice and the Dutch Lower house has recommended its rejection outright. Hundreds of thousands of people have come out in demonstrations against ACTA throughout Europe and the United States.

“ACTA may well go down if governments listen to their people and parliamentary committees, however, many of the interests that drove ACTA are currently driving the Trans-Pacific Partnership Agreement – the obligations of this Agreement being negotiated in secret will affect very similar areas such as affordable medicines, Australian content and digital copyright issues,” Senator Ludlam concluded.

The American Psychiatric Association is on the verge of following disgraced Harvard Professor Joseph Biederman’s ‘Juvenile Bipolar’ lead and condemning irritable children to a label of ‘Disruptive Mood Disregulation Disorder’ and ’off label’ antipsychotics.

The central characteristics of ‘Disruptive Mood Disregulation Disorder’ proposed for inclusion in DSM5 are childhood “irritability” and “temper outbursts” occurring, ”on average, three or more times per week”.1 Disruptive Mood Disregulation Disorder represents a disturbing evolution of the absurd and dangerous practice of diagnosing children, even very young children, with ‘Juvenile Bipolar Disorder’. Although not an official psychiatric disorder Juvenile Bipolar Disorder was enthusiastically and successfully promoted by disgraced Harvard University Professor of Psychiatry, Joseph Biederman.

Biederman, who was also Director of the Johnson & Johnson Centre for Paediatric Psych-Pathology research at Massachusetts Hospital and according to the New York Times is the “the world’s most prominent advocate of diagnosing bipolar disorder in even the youngest children and of using antipsychotic medicines to treat the disease”.2 He is largely responsible for the enormous growth in US antipsychotic prescribing rates to children including Johnson & Johnson’s very profitable antipsychotic Risperidone (brand name Risperidal). In April Johnson & Johnson were fined US$1.2Billion by an Arkansas court for making misleading claims about the safety of Risperidal. This followed similar outcomes in other US states.3

In 2011, US congressional investigations led by Iowan Senator Charles E. Grassley exposed that Biederman received at least US$1.6m in undisclosed fees from drug-makers from 2000 to 2007 and only revealed a tiny fraction of this income to Harvard University.4 The New York Times reports “court documents dating over several years that Dr. Biederman wants sealed showed that he told the drug-giant Johnson & Johnson that planned studies of its medicines in children would yield results benefiting the company”.5

Taking and not disclosing drug company money and planning beneficial research results is reprehensible behaviour. Harvard University’s decision to effectively give Biederman little more than a rap on the knuckles brings discredit to one of the world’s most prestigious universities.6 Perhaps Harvard was motivated more by the funding that Biederman and his cronies attract to the university than by the damage they bring to the university’s reputation. Harvard’s failure to take strong ethical action against Biederman has meant that his influence, although waning, is still considerable.

Thankfully Juvenile Bipolar Disorder is not officially recognised as a diagnosable condition in the current DSM (DSMIV). Supporters lobbied to have it included in the DSMIV, however the DSMIV development committee “found scientific support unconvincing and refused to do so”.7 Regardless, hundreds of thousands, possibly millions, of children have been diagnosed with the unofficial disorder and treated with anti-psychotics like Johnson & Johnson’s Risperidal.8 These medications “can cause serious complications – major weight gain, obesity, diabetes, cardio vascular disease and possibly shortened life expectancy. Sudden death has occurred in a few cases where excessive doses and/or multiple drugs were given to very young children.”9

The proposal to include Disruptive Mood Disregulation Disorder is in part a reaction to criticisms of the use of anti-psychotics for Juvenile Bipolar Disorder. The authors of DSM5 are proposing Disruptive Mood Disregulation Disorder as an alternative to the diagnosis of Juvenile Bipolar Disorder, using the rationale that this will help curb anti-psychotic prescribing rates to children. In effect, they are proposing a “juvenile bipolar light” disorder.

Given the unrestrained enthusiasm for prescribing psychotropics ‘off label’ to children exhibited by many clinicians, particularly paediatricians, the opposite is likely to occur.10 The inevitable outcome is that more children will be diagnosed and experience tells us the more children diagnosed with a ‘psychiatric disorder’, the more children are subjected to the cheap and convenient practice of speculative ‘off label’ prescribing.

The only sensible course of action for the American Psychiatric Association is to reject out-of-hand the notion of Juvenile Bipolar Disorder or any lighter version thereof including Disruptive Mood Disregulation Disorder. Failure to do so will drag the American Psychiatric Association into another epidemic of childhood drugging for which, unlike ADHD, they currently bear no responsibility.

We aim to give workshop participants an insight into the headspace of one who self-abuses in order to better understand their ‘real’ world and experiences; focussing specifically on their thoughts, feelings and behaviours.

Throughout the workshop we encourage participants to employ strength based practice, in collaboration with their clients, as a means to discovering a myriad of healthier alternative behaviours to use in response to their inner trauma.

As self-abuse does not impact solely on the physical aspect of an individual’s life, we link self-abuse to its impact on the, mind, spirit and social aspects of life and explore the related long term effects.

We also discuss the connection between self-abuse and suicide, BPD [Borderline Personality Disorder], mental illness, sexual assault, domestic violence and adolescence.

The presentation mode for the workshop is both interactive and activity based and includes ‘real’ case studies, PowerPoint presentation and DVD.

Each workshop participant is provided with a SAFE in Oz brochure, pen and presentation folder. The folder includes a workbook for each day which contains a copy of the PowerPoint presentation, activity pages and additional subject related reference material.

The activity sheets include strategies and tools for use with clients, while the reference material acts to enhance understanding and give insight into related topics.

Western Australia a Carbon Emissions Catastrophe

On the eve of Australia’s Prime Minister attending the Rio+20 United Nations Conference on Sustainable Development, research recently released by the Greens WA spokesperson on Climate Change, Robin Chapple MLC, shows that WA is tracking ‘off the scale’ for carbon emissions increases.

The findings of this research are disturbing. In the coming decade, when we should be constraining the growth of carbon emissions and making clear plans to reduce our future emissions, WA is instead set to increase its greenhouse gas emissions vastly and rapidly.

Western Australia’s emissions in 1990, the benchmark year for Kyoto Agreements, were 52.0 million tonnes of carbon dioxide equivalent (CO2e), and by 2009 this had grown to 69.9 million tonnes.

This new research shows that emissions are now in the region of 85 million tonnes of CO2e per annum. The most worrying finding of this research is that pending industrial development is set to emit a further 83 to 128 million tonnes per annum.

These new projects, if approved and operating at full scale, could see our emissions more than double during the coming decade, and more than triple that of our reporting base year of 1990.

“As the primary regulator of industry in our state, our State Government should play a key role in facilitating the transition from a carbon intensive economy to a low carbon, clean economy,” said Robin Chapple today.

“However the current State Government has no policy on how we will support the Commonwealth in meeting Kyoto and National targets, and it sets no articulated targets of its own.

I consider industrial development left unmeasured and unmonitored, with no clear commitment to disclose emissions profiles, or manage and reduce emissions and energy use, tantamount to negligence on the part of the State and call on this Government to consider future generations before it considers mining profits,” stated Mr Chapple.

Did you know that entire communities in Mexico are at risk of disappearing because of dam projects?

In the three communities we are currently working with alone, more than 40,000 people are facing the threat of forced eviction. This means loss of homes and jobs, inadequate access to schools, hospitals, infrastructure and more.

We’ve just found out that this November, a panel of international human rights experts will be visiting Mexico to lead a special hearing on the issue of dams and human rights violations. This is a crucial moment for dam-affected communities to use an international spotlight to pressure the Mexican government and call for accountability for their role in imposing these projects.

Right now, we now have an unexpected opportunity to bring our local partners together for a three-day intensive training to create a video for the hearing that tells the larger story about dams, forced evictions and human rights in Mexico. But we have a gap in funding. We need your help to raise $4,000 in the next 48 hours to make this training happen.

We are lucky – all we need is $4,000 to bring ten activists together for three days in August. I will already be in Mexico – so we are saving on airfare and lodging. The all-inclusive community event to celebrate the diversity of our cultures and the new lives of refugees in Australia begins at 11am on Saturday, June 23rd, at the Fremantle Esplanade.

Greens Senator for Western Australia Scott Ludlam and MLC for South Metropolitan Lynn MacLaren will attend the event, which is hosted by The Greens, the City of Fremantle, Amnesty International, Anglican Social Responsibilities Commission, ASeTTs (Assisting Torture and Trauma Survivors), CASE for Refugees, Coalition for Asylum Seekers, Refugees and Detainees (CARAD), Fremantle Multicultural Centre, Kulcha, Oxfam, Project SafeCom, the Refugee Rights Action Network and the Uniting Church Social Justice Board.

Senator Ludlam said the fiesta was an important event for reminding us of the best things about Australia.

“People fleeing war and persecution who come to Australia to seek a better life for themselves and their kids are welcome regardless of how they come. The false and bizarre fusion of the unrelated issues of asylum seekers and border protection has warped the national debate, and made us forget what kind of country we really are – welcoming, tolerant, prosperous, spacious and above all – extreme lucky,” he said.

From 11am until 1pm the Fremantle Esplanade will host music, dance, food stalls, and soccer. At 1pm ‘Walk Together’ begins – a walk for harmony through Fremantle. The Fiesta ends at 4pm.

WikiLeaks founder Julian Assange’s dramatic bid for political asylum in Ecuador is a clear declaration of no confidence in the Australian Government’s willingness to protect him from US prosecution, the Australian Greens said today.

A statement from the Ecuadorian foreign ministry notes Mr Assange has argued: “a regrettable factual statement of abandonment received by the authorities of my country, Australia”.

The statement notes that the matters subject to grand jury investigation in the United States carry long jail terms and potentially the death penalty.

“Against this, we have the Australian Government’s feeble assurances that it has done all it can. Apart from recklessly and incorrectly declaring the work of WikiLeaks illegal, the Government’s contribution has amounted to malign indifference,” Australian Greens communications spokesperson, Senator for Western Australia Scott Ludlam said.

“I hope to raise the issue later today in Senate question time.

“It is highly significant that the Ecuadorian authorities said they have contacted the British, Swedish and US governments on this matter but not Canberra.

“For the time being, this matter is in the hands of Ecuadorian authorities. I urge them to consider carefully the targeted campaign of political harassment, character assassination and financial sanctions that has been levelled at the WikiLeaks publishing organisation.

“While we wait, the Australian Government might want to reconsider on which side of history it is choosing to stand.”

A law firm’s report indicating almost 900 people have made plausible allegations of abuse within the Australian Defence Force demands an urgent and comprehensive response, the Australian Greens said today.

The Greens acting defence spokesperson Senator for Western Australia Scott Ludlam said a top-level inquiry was needed to come to grips with the full extent of the culture of abuse and silence that has allegedly plagued the ADF for decades.

“This report alleges a long and disturbing history of abuse and cover-ups. A Royal Commission is needed to establish what happened, why it was able to happen, and what must be done to ensure it never happens again,” said Senator Ludlam.

“This report claims ‘many young males and females have been subjected to serious sexual and physical assault and other serious abuse while they were in the ADF from the 1950s at least into the 21st century’. Determining the facts and compensating the victims is important but it can’t end there. We must make the changes necessary to protect the young people who join the defence forces from this kind of horrendous treatment.”

Australian Mental Health at the Crossroads – time to reject further medicalization and recover sanity

Mental health policy in Australia, for so long ignored, is finally getting attention. The Australian and West Australian governments have appointed their first Mental Health Ministers and significant resources are being identified for new and expanded services. In addition sport stars, celebrities and politicians have publicly shared their personal battles with depression, bipolar and a host of other mental health problems – helping to ‘de-stigmatise’ mental illness.

To casual observers it may appear at last we are on track to a happier, mentally healthier tomorrow, however appearances can be misleading. The future direction of mental health in Australia is far from certain.

Just about everybody involved in the debate agrees things need to change, but this is where the consensus ends. There are at least three different directions on offer. For the want of better descriptions, I will call them the ‘Americanisation’, the ‘Preventative Psychiatry’ and the ‘Recovery’ approaches.

Apart from spiraling mental health prescribing rates the most obvious evidence of the Americanisation of Australia’s mental health system is the dominance of the American Psychiatric Association’s Diagnostic and Statistical Manual of Mental Disorders (DSM) diagnostic model. Often referred to as the ‘Bible of Psychiatry’, the current edition, DSM-IV, outlines the diagnostic criteria of 297 psychiatric disorders.

Like the yellow pages, subsequent editions of the DSM have thickened as new disorders have been added. This expansion has been exploited by aggressive pharmaceutical company marketing, resulting in the ‘medication’ of people who would previously have been regarded as ‘normal’.

With the benefit of hindsight Professor Allen Frances, the Chairman of the Task Force that developed the DSM-IV, regrets aspects of the DSM-IV as having helped to trigger “false epidemics” including “the wild over-diagnosis of attention deficit disorder.”1

Professor Frances is particularly worried about the next edition, DSM-5, due for publication in 2013. He contends that further diagnostic expansion driven by the inclusion of pet disorders of enthusiastic researchers will see even more ‘normal’ people made patients and more over-prescribing of psychotropic drugs.

Thankfully there is a significant international revolt, led by Professor Frances, from within the psychiatric and psychological professions, against the further medicalisation of behaviours proposed for DSM-5. This has already caused the American Psychiatric Association to abandon some of its more controversial DSM-5 proposals including ‘Psychosis Risk Disorder’ and the expansion of the already absurdly broad diagnostic criteria for ADHD.

Australia’s most prominent psychiatrist, former Australian of the Year, Professor Patrick McGorry, has also expressed concern about the over-prescription of psychiatric drugs in the US, however he argues the risks aren’t as great here.2 Unlike the US we don’t allow direct advertising to consumers, however the pharmaceutical industry aggressively market their drugs to the Australian doctors who prescribe them. They also sponsor medical research, conferences, educational opportunities and even patient support groups that ‘raise awareness’ of the disorders their drugs treat. Australia is far from immune from undue pharmaceutical company influence.

Professor McGorry is arguably the world’s most prominent advocate of Preventative Psychiatry. He believes that prior to the onset of psychosis, depression and other serious mental illness there is a ‘prodromal phase’ and that intervening then will help save many the misery of full blown mental illness.

Critics of Preventative Psychiatry, including Professor Frances, contend it simply doesn’t work. They argue you can’t predict with sufficient accuracy, who will go onto become ill and that even when it is accurate, independent evidence indicates that preventative measures don’t work.

Even Professor McGorry acknowledges that the vast majority of people that are identified as being at Ultra High Risk of developing psychosis, his specialist area, never do.3Nonetheless, he argues the benefits of predictive intervention massively outweigh the risks of doing nothing.

The belief intervention could prevent psychosis was part of the rationale for the Gillard Government’s 2011 decision to allocate $222.4million for the role out of Early Psychosis Prevention Intervention Centres (EPPICs) across Australia. At the time of the decision it looked very likely that DSM5 would include a ‘Psychosis Risk Disorder’. Now that is not happening, the future of the ‘preventative’ function of EPPICs is uncertain.

Adding to this uncertainty is Preventative Psychiatry’s long and continuing history of unsuccessfully experimenting with psychotropic drugs as a means of ‘immunizing’ people considered at elevated risk of future mental illness. While EPPICs will provide a broad range of psychosocial services and also treat patients who are already psychotic, significant questions remain unanswered.

The final option, the Recovery approach, centres on developing a patient’s own capabilities and resilience. As opposed to the ‘ongoing disability’ or ‘impending doom’ assumptions inherent in the Americanisation and Preventative Psychiatry approaches, the Recovery approach is more optimistic about the capacity for recovery and less reliant on pills. It supports mentally ill patients with housing, educational, employment and psychosocial support – building blocks for a healthy and happy mind that can’t be replaced by drugs.

While the Recovery approach is more optimistic about human resilience, it is more realistic about the limits of psychiatry than either of the other approaches. The Americanisation approach is based on the unrealistic assumption that psychiatric science can accurately identify at least 297 different disorders, and the Early Intervention approach on the fanciful notion that mental illness can be reliably spotted before it happens.

Unfortunately a significant disadvantage for the Recovery approach is that it offers a pessimistic outlook for the profitability of pharmaceutical companies. If history is any predictor of the future this could prove to be its’ fatal flaw.

Labor’s nuclear cheerleader Martin Ferguson put on a rose-coloured blindfold before delivering his rote speech at the uranium conference in Adelaide today.

The Greens nuclear policy spokesperson, Senator for Western Australia Scott Ludlam, said the Minister’s enthusiasm for nuclear power flies in the face of the grim reality.

“On Monday we had the news Europe will decommission most of its nuclear power stations by 2030 – almost 150 nuclear power stations will be gone from Europe – and 48 hours later we have Federal Minister Martin Ferguson, like an obsessed lifeguard, trying to pump life back into the industry.

“In the wake of the Fukushima disaster several European countries decided to completely phase out their nuclear sectors. Germany and Belgium aim to end production by 2030 and Switzerland by 2034. Canada will close 17 nuclear stations by 2030, and the US will close at least five. Yet the Minister relies on figures provided by self-interested industry groups to claim growth is just around the corner.

“In India – a country that has refused to sign the Nuclear Non-Proliferation Treaty – there is a mass movement against nuclear power that is growing in size and momentum. In China we know next to nothing about the safety record of nuclear technology, but we do know the Government is undertaking the world’s biggest investment in expanding renewable energy.

“BHP is backing away from its plans to expand Olympic Dam. The Minister held up the proposed Wiluna uranium mine in WA as a sign of good times to come: that troubled project, run by an outfit that has never operated a mine, is being opposed on all fronts. Even the market has turned its back, with TOE stocks trading close to a four-year low.”
